In 16% of the cases there was no evidence that the required sponsor safety checks had been carried out. Almost one in five UACs was “released to sponsors with FBI fingerprint or state provision and neglect register controls” – and when those results came in, the files were never updated. In one third of the cases, the identification documents “contained readability problems” contained ” – a nice way to say that ORR could not read well to confirm that they were valid.
What if the sponsors did not take care of the children or operated them? Nobody knew it. In most cases, the follow-up of ORR was just a phone call.
In 22% of the cases, HHS investigated: “ORR did not carry out timely safety and welfare calls”, and in another 18% of the cases they did not document those calls in the files. That was at the beginning of 2021 -and the UAC numbers later became worse in the Biden. So far, the Trump administration has found 13,000 of the UACs that have been deposited off the radar.

Nowadays ORR requires good identification, with fingerprints, photos, DNA samples, as well as background controls and financial data before they release children. Alien adults in the US who have asylum claims – even fake or fraudulent who will eventually fail – can still pick up their children from ORR and keep custody pending the family’s immigration process. Now that ORR is strictly verifying the identities of parent and sponsor, the average time that children continue to grow in custody of a few weeks to months. That is proof of how weak the bedsides for sponsors have been over the past four years. Many teenagers who came here to leave their parents abroad choose to go home instead of staying in custody for longer.
The federal law requires that the government “ensures that non -counselor children in the United States are safely repatriated in their country of nationality.” That should now be the priority. Subsequently, the congress must close the UAC -Mazen in immigration legislation and return the responsibility of guardianship from HHS back to DHS, so that never again so many children run the risk of seriously harming them and spreading the cracks of an immigration system under too many federal agencies.
