President Donald Trump On Friday, a federal court requested a request from the Governor Lisa Cook of the Federal Reserve to prevent the president from firing her because the legal proceedings in the court case to block its removal.

“On the basis of which standards facial contradictory declarations in financial documents – or a criminal lawyer can be enforced or not – it is more than sufficient to remove a senior financial regulator from his office,” said the submission of the Trump administration.
The Federal Reserve and Chairman Jerome Powell were also mentioned as defendants in Cook’s court case, although that is only to ensure that Cook can obtain legal exemption and stay in its role as Fed Governor if she has the upper hand in her legal case against the removal effort.
The submission of the FED explains that although the central bank has the authority to be independent under the Federal Reserve Act and will be present during Friday’s hearing, “It is not intended to offer arguments about the motion of Governor Cook.”
“At present, the board only issues its interest in a rapid ruling from this court to remove the existing cloud of uncertainty; and (2) the intention to follow each order that this court has issued,” stated the FED application.

The Cook’s lawsuit opposes the claims of the Trump government that it can be removed after the reference and says that federal laws that cover the removal of officials at other agencies neglect, failure or inefficiency in function while they are in function as the standard of a “for cause” removal.
“There is no conceivable interpretation of ‘for cause’ removal protection that could dismiss the President the Governorkok, either for his true motif or the pretext he invented,” said Cook in the motion that sought a temporary limiting order.
Such orders cannot generally be set higher, but if Judge Jia Cobb of the American court grants the restrictive order, this would probably be an order in the longer term that a court of appeal could be revised. Cobb said that she would put an accelerated briefing schedule in the case during Friday’s hearing.

The case is likely to reach the American Supreme Court, where a conservative majority has for the time being permitted to dismiss officials from other agencies, despite laws protecting them against removal – although a statement in May distinguished the Federal Reserve of those agencies through its unique structure and “different historical tradition”.
The legal dispute comes in the midst of the efforts of the Trump government to put pressure on the filled interest rates. If Cook is removed, Trump would allow Trump to use his fourth pick at the seven -member board of the FED, all of whom serve in the Federal Open Market Committee that monetary policy decisions.
Trump has repeatedly criticized FED chairman Powell, whom he appointed in 2017 for the interest rates and reportedly to reduce an expensive renovation project.

Although the president has threatened to dismiss Powell several times, the president has recently supported those threats lately, since Powell’s term of office as chairman will end in May.
The FED is expected to lower the interest rates during its next policy meeting mid -September in the midst of signs of a weakening labor market, despite the inflation that remains above the purpose of 2% of the FED.
