On July 15, President Trump nominated my friend and former Gorsuch Clerk colleague Eric Tung at the American Court of Appeal for the ninth circuit. If confirmed, Tung Judge Sandra Ikuta will follow, who recently recorded the senior status after a major term. Judge Ikuta leaves a strong legacy, one Tung is more than rested to maintain and expand.

The references of Tung are exceptional. He obtained a philosophy diploma from Yale in 2006 and graduated in 2010 with high awards at the University of Chicago Law School. As he was there, he served as editor -in -chief of the University of Chicago Law Review, one of the rigorous legal journals in the country.

Tung’s sparkle, ethics and temperament have given him two -part respect. A letter to support his nomination was signed by colleague Supreme Court Clerks from the entire ideological spectrum, from Justice Ginsburg’s to Justice Thomas’. That level of cross -resistant support is rare and speaks volumes.
A signer, Danielle Sassoon, a former federal public prosecutor who did not agree with the Trump government, did her best to endorse Tung. Her support underlines how broad he is for his intellect and integrity, regardless of politics.
Ultimately, what really matters, the record of Tung, and it is inviolable. He is a brilliant legal mind, an honest lawyer and a devoted constitutionalist.
Tung’s experience goes much further than the top of the legal profession. He served in the Office of Legal Policy of the Department of Justice, where he helped Doorne -Legal nominees, so that he looked at what makes a good judge. As an assistant -American lawyer in Los Angeles, he continued serious criminal cases and received invaluable value that got invaluable. Despite this flawless record, the hearing of the Senate Committee of Tung was marred by partisan Theatrics. Several democratic senators ignored his qualifications and fixed instead on posts on social media that I had written. Senator Dick Durbin, D-On., Quoted part of an old post from mine and demanded Tung “condemn” it. Tung, who remarked the canons of judicial ethics, rightly refused to weigh, so that my opinions are not necessarily his.
Sen. Cory Booker, DN.J., followed the example and hit Tung about a post where I had labeled certain Democrats ‘Evil Marxists’. Booker then tried to cast himself as a model of dual courtesy, referring to his friendship with senator John Kennedy, R-La., Easily omit that he once claimed supporters of Justice Brett Kavanaugh’s confirmation to the US Supreme Court “complicit to evil.” Again, Tung refused to be attracted to political greatness, with the reluctance and balance that we would expect from a federal judge.
This debt conversion of attacks is unfair and irrelevant. Tung’s record speaks for itself. Instead of dealing with his legal merits, some senators tried to hijack a hearing of the judicial committee to score cheap political points. Tung never took the bait.

His nomination also emphasizes the double standard in how judicial diversity is treated. If the son of Chinese immigrants and a smooth mandarin speaker, one would think that Democrats would celebrate Tung, at least because of their holy statistics of representation and diversity on the federal bank. But because he is a conservative, his background is triggered or even used against him. The selective celebration of diversity and identity policy in judicial nominations is striking.
Ultimately, what really matters, the record of Tung, and it is inviolable. He is a brilliant legal mind, an honest lawyer and a devoted constitutionalist. His combination of courtroom experience, academic strictness and ethical clarity makes him an ideal judge.

The Senate must rise above the political attitude and confirm Eric Tung without delay. His confirmation will not only strengthen the ninth circuit, but reinforce the rule of law nationally. The reform of President Trump of the federal judiciary with principle, constitutionalist judges will take an important step forward with the appointment of Tung.
Eric Tung is exactly the kind of judge that Americans want: sharp, stable and meticulously honest. The Senate must act on the return and confirm him in September.
