“I hereby advocate incompetence and stupidity.”
That’s probably the best defense Minnesota Gov. Tim Walz can offer if he is criminally charged for the shocking multi-billion dollar rip-off of taxpayers that is growing bigger by the day.
Given his earned reputation, his excuse for incompetence would be credible.
Nearly every social service program that received federal dollars was snatched right from under Walz’s nose by fraudsters, including child nutrition, child care, health care, housing and autism assistance. Most of the perpetrators were Somalis who form a powerful voting bloc that the governor treasures like gold.

Walz was repeatedly warned about the scam as early as 2019, when he first came to power. Instead of stopping the scams and prosecuting the scammers, he surrendered to them by creating a culture of condoned fraud.

The scandal has already claimed Walz’s political career and forced him to do so abandoning his bid for re-election. But if he thought quitting would somehow protect him from legal culpability, he was mistaken. There is more and more evidence that Walz was willfully complicit, deliberately refusing to expose or prosecute the monumental thefts and instead launching aggressive measures to undermine any legal investigation and criminal consequences.
The governor’s own state workers at the Department of Human Services issued a blistering statement accusing him of 100% responsibility. Witnesses say he retaliated against whistleblowers and plans to discredit the well-documented fraud reports.

If true, Walz’s deviant actions come dangerously close to criminal behavior involving cover-up and obstruction.
Nine federal agencies, including the FBI, are now working to unravel the full breadth and depth of the colossal drawbacks. The Department of Justice (DOJ) has sent dozens of investigators and attorneys to Minnesota to prosecute the web of fraud and deception.
They will inevitably weigh whether Walz himself should face criminal charges.

Possible federal charges
There are several federal statutes to consider. For example, 18 USC 371 makes it a crime to conspire with others to defraud the government. At this time, there is no known evidence that Walz himself directly participated in the scam or accepted any money.

However, if he conspired to cover up the fraud by obstructing, obstructing or thwarting efforts to bring the fraudsters to justice, the conspiracy statute applies. This also applies to the various laws against obstruction of justice.

There is also 18 USC 2, the aiding and abetting statute, which treats accomplices the same as the primary perpetrators. That law gave rise to the “intentional blindness doctrine” recognized by our courts.
An example is a businessman who deliberately ignores or condones his partner’s money laundering, resulting in charges against both. Likewise, a public official like Walz can be charged with willful inaction even though he has a clear duty to act.
Finally, 18 USC 3 is relevant when concealment occurs. Anyone who knows that a crime has been committed but ‘obstructs apprehension, trial or punishment’ is guilty of accessory after the fact. That bears a striking similarity to what Walz is accused of.

All this begs the question of the governor’s motive. If it wasn’t money, how could he profit from suppressing the avalanche of fraud? That’s the easy part. To vote.
Walz, along with liberal elites and their media handmaidens, have long dismissed rumors and reports of Somali fraud as “racist.” Apparently it is politically incorrect in Minnesota to enforce the law against immigrants from that particular East African country. It’s just not fashionable.
God forbid, putting criminals behind bars might lose electoral support. It’s chic to turn the other cheek.

So the Somali fraudsters were given a free get-out-of-jail-free card, courtesy of the governor and his henchmen. Walz, in turn, secured their votes. It was a convenient return, but with an alternative currency: votes. As protection rackets go, it was slippery.
This cozy arrangement is reflected in a… recently discovered audio recording from a 2021 conversation between Walz’s Attorney General Keith Ellison and Somali scammers who were soon after convicted of defrauding them of millions of dollars. They were heard leaning hard on the AG to “protect” them in exchange for support and campaign donations.
Ellison eagerly capitulated, but now denies any wrongdoing. He gave the money back.
Walz’s incompetence defense
It is still too early to know whether a criminal case will be filed against Minnesota’s beleaguered governor. The U.S. Attorney and DOJ attorneys are still sifting through the mountains of evidence.
However, as noted above, the only tenable defense Walz can come up with is incompetence and stupidity. It’s something jurors could easily accept.

Incompetence finally became the governor’s calling card. He infamously admitted his own buffoonery during the 2024 vice presidential debate when he called himself a “knucklehead.” He was such a blunder factory that the Kamala Harris campaign has driven him away from the media.
Walz achieved the impossible. He made his running mate look like a genius. His bizarre antics on stage were constant fodder for ridicule. Baffling verbal quips, such as bragging that he had “become friends with school shooters,” left voters scratching their heads or chuckling.
A series of demonstrable lies about his military service and his peculiar trips to China only reinforced the impression of a man who is either a serial producer or out of his mind. Maybe both are true.
And who can be epic messing with the George Floyd riots in 2020? He radicalized the tragic death, fueling the subsequent violence. As Minneapolis burned, Walz hesitated. Afterwards, he blamed the looting and burning of buildings on systemic racism.

So it’s not hard to imagine that an indictment alleging that Walz was knowingly complicit in his state’s massive welfare fraud scandal could be met with a defense of “wrongfeasance” (careless or incompetent performance of a lawful duty) to challenge the incriminating evidence of “moldfeasance” (an intentional, unlawful act).
It is a distinction that can mean the difference between conviction and acquittal.
