When Ice visited a new battery plant last week by the Korean company Hyundai, they started finding various alien beings who worked illegally there – from Latin -America. They probably did not expect them to roll up hundreds of illegal South Korean employees at the same time.
This came as a surprise for the national media and even some immigration experts. But the problems underlying the migration of Ice of illegal Korean labor are no secret.
First the visa of the B -visitor. The B-1 is for business trips, the B-2 is for personal reasons such as tourism or visiting family members. There are so many different things that an alien can do on a B that they are normally spent as one B1/B2 visa to keep it easy.

The B visa only enables a foreigner to access the US at an air or country port. There, customs and border protection can come in for a certain period. Usually that is six months.

Although an alien cannot work full-time on a B visa for a longer period, they are allowed to have meetings, to repair or install, patented machines and specialized training for American employees. So, some of the Koreans could have applied for B -Visa and came to Georgia to work on machines or train Americans to do it. So far, so legal.
But Koreans can also enter the US for a maximum of 90 days under the Visa Waiver Program (VWP) for business or pleasure. They are explicitly not allowed to work under the VWP. Nevertheless, visitors from many countries have abused the VWP, for example Israeli youngsters who come to VWP and sell Dead Sea in shopping centers for the summer, or Chileans who come to commit organized burglary.
It seems that some of the Koreans came under the VWP and worked illegally. They most likely worked for subcontractors who hired Hyundai for work. Hyundai may have done this in good faith, assuming that the subcontractors did the necessary diligence. But the use of subcontractors to prevent control and bringing cheap labor is a common tactic among large and small American and foreign companies.

Then there is the H-1b. Despite their legal purpose, and various attempts to resolve meshes, H-1Bs have been abused to replace American employees and as a source of cheap work for a generation. American companies from alphabet to Walmart have hundreds of thousands of H-1B foreign employees, sometimes directly but often by outsourcing companies such as Cognizant, HCL or Tata Consultancy Services. Most large ones are located in India or owned by Indians, and India is the source of almost all their employees.
In addition to the H-1B, companies also abuse the L-visa, that is intra-companies for transfers. In theory this should be for a foreign company, such as Volvo or Toshiba, to get a director to work in their American branch for a few years and then go home. However, the L has been abused by mother and pop motels and restaurants to bring in family members, and as a back door when the H-1B annual numerical caps are reached.
About those illegal immigrants in the United States
When I published Visa 25 years ago, large Indian out-sourcing/consultancy firms would hire young people from the university. After at least 12 months that they had to work for the company before they were eligible for an L visa, they would send them to work for their American subsidiary. They would take them as ‘consultants’ for American companies and a big cut.
Apart from the visa fraud and abuse, the Hyundai debacle raises light on another question: if Hyundai wants to hire Americans, right? In the skilled technical areas, yes – there are many of us Stam – graduates who do not work in that area, and unemployment for recent graduates is twice that of older employees. But factories also need skilled labor. In Georgia, only half of the eighth classes scored “on or above basic” and only a quarter “on or above skilled” in mathematics.

Foreign investments in the US can be a victory/victory, but only on fair conditions. To prevent more Hyundai debacles, we need two things.
First of all, we should not let the American or foreign companies import cheap work to compete with our own graduates and employees. Unlike a few managers, technical specialists and native speakers, companies such as Hyundai can recruit the majority of their American workforce here in the US
